Biletskyi & Partners Law Firm successfully registered industrial designs for packaging for confectionery products

The client turned to Biletskyi & Partners Law Firm to register two industrial designs for packaging for confectionery products.

An industrial design is the result of a person’s creative activity in the field of artistic design. An object of an industrial design can be a shape, pattern or color, or a combination thereof, which determines the appearance of an industrial product and is designed to satisfy aesthetic and ergonomic needs.

The ownership of the industrial design is certified by a patent. A patent grants its owner the right to prohibit other persons from using the industrial design without his permission, as well as the right to issue licenses to use the industrial design on the basis of
license agreements.

Given the time to provide additional materials to the application, requested by the Ministry of Economic Development and Trade of Ukraine, the registration deadline for industrial designs was up to 8 months. The average registration period for an industrial design is up to 6 months.
